A bill to amend 1954 PA 116, entitled
"Michigan election law,"
by amending section 797 (MCL 168.797), as amended by 1992 PA 8.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 797. (1) Not less than 30 minutes before the opening
2 of the polls, the inspectors
of election inspectors shall
3 arrive at the polling place and prepare the polling place for
4 voting. The inspectors
of election inspectors shall determine
5 that the correct ballot has been provided to the precinct by
6 comparing the ballot provided with the sample ballot and any
7 other documents provided
to the precinct. The inspectors of
8 election inspectors shall complete required tests of the
9 equipment of the electronic voting system and certify in writing
10 that the equipment is operating properly. The written
11 certification shall be on a form prescribed by the secretary of
1 state and shall include pertinent information regarding seal
2 numbers, counters, and the operation and use of the particular
3 equipment.
4 (2) If electronic tabulating equipment in use at the polling
5 place can detect and inform an elector that the elector's ballot
6 has been rejected, as part of the testing required under
7 subsection (1), the election inspectors for the polling place
8 shall ensure that this notification feature is operating properly
9 before certifying the equipment under subsection (1). Unless a
10 notification feature ceases to operate properly, that feature
11 shall not be switched off or otherwise disabled. If a detection
12 and notification is switched off or otherwise disabled, the
13 election inspectors shall make a written record of the reason for
14 and exact time of the inactivation.
