A bill to amend 1956 PA 218, entitled
"The insurance code of 1956,"
(MCL 500.100 to 500.8302) by adding section 3109b.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 3109b. (1) An insurer shall disclose, in writing and
2 in plain English, what is meant by, and occurs to, personal
3 protection insurance benefits that are coordinated with other
4 health and accident coverage on the insured.
5 (2) The insurer shall provide the disclosure under subsection
6 (1) to an applicant or insured at the time the applicant or
7 insured elects for personal protection insurance benefits to be
8 coordinated with his or her other health and accident coverage.
9 (3) The insurer shall provide the disclosure under subsection
10 (1) at the next renewal following July 1, 2004 to an insured who
11 is covered on July 1, 2004 by an automobile insurance policy that
1 provides for personal protection insurance benefits to be
2 coordinated with his or her other health and accident coverage.
3 Enacting section 1. Section 3109b of the insurance code of
4 1956, 1956 PA 218, MCL 500.3109b, as added by this amendatory
5 act, takes effect July 1, 2004.
