A SUMMARY OF HOUSE BILL 4032 AS INTRODUCED 1-27-05

The bill would amend the Michigan Vehicle Code to provide city councils a role in setting speed limits on state trunk line highways that are within city limits.

Currently, the Vehicle Code says:

If the State Transportation Commission and the director of the Department of State Police jointly determine upon the basis of an engineering and traffic investigation that the speed of . . . traffic on a state trunk line highway is greater or less than is reasonable or safe . . ., the officials acting jointly may determine . . .a reasonable and safe maximum or minimum on that state trunk line highway . . .

The bill would amend that language to include "and the city council if a state trunk line highway is within the limits of the city."  As a result, a city council would, along with the State Transportation Commission and the director of the Department of State Policy, jointly make the determinations cited earlier.
