CONTENT
The bill would amend the Michigan Vehicle Code to allow local authorities and county road commissions to prohibit, by ordinance or resolution, the use of compression brakes on portions of State trunk line highways within their limits that lie within 200 yards of a residential area. A person who violated the ordinance or resolution would be responsible for a civil infraction.

A local authority or county road commission that prohibited the use of compression brakes under the bill would have to indicate the prohibition by appropriate signs conforming to the Code's requirements placed on the State trunk line highways. The local authority or county road commission and the Michigan Department of Transportation would have to bear the cost of erecting the signs equally.


As used in the bill, "compression brakes" would mean brakes commonly known as "jake brakes".

FISCAL IMPACT
The fiscal impact of the bill cannot be determined at this time. Because the bill's language is permissive rather than mandatory, the cost of implementation would depend upon the number of local jurisdictions choosing to prohibit the use of compression brakes.
