A bill to amend 1949 PA 300, entitled
"Michigan vehicle code,"
(MCL 257.1 to 257.923) by adding section 310f.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 310f. (1) The secretary of state shall establish a
voluntary youthful driver monitoring program to provide information
to the parents and legal guardians of youthful drivers.
(2) The program shall include all of the following:
(a) A placard or decal for display on the exterior of a motor
vehicle that includes a number that is uniquely identifiable to a
youthful driver. The placard or decal shall also include toll-free
contact information that allows an observer to report driving
behavior.
(b) An information collection service for reports concerning
youthful drivers.
(c) A distribution service for prompt relay of information to
the parents or legal guardian of the youthful driver who is
identified as the subject of a driving report.
(3) The secretary of state shall authorize 1 or more private
entities to operate the program. The secretary of state is
authorized to release information to a program operator as
necessary to operate the program. An entity operating the program
shall comply with standards adopted by the secretary of state to
ensure the efficacy and integrity of the program. The secretary of
state may authorize an entity that operates the program to receive
a fee that does not exceed $50.00 for each youthful driver.
(4) A program operator and its employees and agents shall
protect the privacy of all identifying information and shall use
the identifying information and other information it receives in
operating the program only as authorized and as necessary to
achieve the purposes of the program. Information identifying
graduated license holders and the driving reports submitted under
the program are not subject to disclosure under the freedom of
information act, 1976 PA 442, MCL 15.231 to 15.246.
(5) As used in this section:
(a) "Program" means the youthful driver monitoring program
authorized under subsection (1).
(b) "Youthful driver" means an individual who is less than 18
years old and who holds a graduated driver license under section
310e.
