November 29, 2005, Introduced by Senators STAMAS, GILBERT, KUIPERS, JELINEK, ALLEN, GARCIA, BROWN, SANBORN and GOSCHKA and referred to the Committee on Transportation.

 

 

 

     A bill to amend 1956 PA 218, entitled

 

"The insurance code of 1956,"

 

(MCL 500.100 to 500.8302) by adding section 2027a.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 2027a. (1) It is an unfair method of competition and an

 

unfair or deceptive act or practice in the business of insurance to

 

require an insured or applicant for insurance to have installed in

 

his or her automobile an event data recorder or to request or use

 

data recorded on an event data recorder to determine eligibility

 

for, or to determine premiums for, automobile insurance.

 

     (2) As used in this section, "event data recorder" means that

 

term as defined in section 682c of the Michigan vehicle code, 1949

     Enacting section 1.  This amendatory act does not take effect

 

unless Senate Bill No. 902                                    

 

          of the 93rd Legislature is enacted into law.
