A SUMMARY OF HOUSE BILL 6269 AS INTRODUCED 6-19-08
The bill would amend Section 16205 of the Public Health Code to provide that a board that requires evidence of attendance at educational programs as a condition of renewing a health occupation license could waive those requirements if, upon written application, the board found the licensee's failures to attend was because he or she was on active duty in the armed forces of the United States or on Governor-ordered military service as a member of the National Guard (hereinafter referred to "active duty").
Under the bill, a board responsible for issuing a license or registration under the act for the practice of a health professional would be required to renew the license or registration issued to an individual that expires while the individual is on active duty. A renewal would be valid for a period of one year from the date the individual is discharged from active duty or until the date the individual successfully renews the license or registration in the manner defined in the act, whichever occurs first. An individual applying for renewal of a license or registration that was last renewed under this provision would be required to submit documentation of active duty service as required by the board. This subsection would not apply to Reservists or National Guard members on activity duty for annual training that is a regularly scheduled obligation for training and not for mobilization.

FISCAL IMPACT:
House Bill 6269 as introduced may have modest state fiscal implications for the Department of Community Health, impacting the boards of licensed or registered health professions. The boards may have increased costs to modify administrative processes to handle the exceptions required by the bill, if processes already in place are not suitable. Costs may also be increased to the Department if the volume of requested education waivers and automatic license and registration renewals is significant; however, most of the latter costs would be covered by the renewal fees charged.
