SUBSTITUTE FOR

HOUSE BILL NO. 6103

(As amended June 24, 2008)

     A bill to amend 2004 PA 452, entitled

"Identity theft protection act,"

(MCL 445.61 to 445.77) by adding section 12d.

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

     Sec. 12d. A person that knowingly violates section 12c may be

ordered to pay a civil fine of not more than [$10,000.00] for each

violation. The attorney general or a prosecuting attorney may bring

an action to recover a civil fine under this section. This section

does not affect the availability of any civil remedy for a

violation of state or federal law.

     Enacting section 1. This amendatory act takes effect November

1, 2008.

     Enacting section 2. This amendatory act does not take effect

unless all of the following bills of the 94th Legislature are

enacted into law:

     (a) House Bill No. 6099.

     (b) House Bill No. 6100.

     (c) House Bill No. 6101.

     (d) House Bill No. 6102.

     (e) House Bill No. 6104.

     (f) House Bill No. 6105.
