A bill to amend 1994 PA 451, entitled
"Natural resources and environmental protection act,"
by amending sections 43528 and 43529 (MCL 324.43528 and 324.43529),
as amended by 1996 PA 585.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 43528. (1) A person shall not hunt bear without a bear
hunting
license. The Except as
provided in subsection (4), the fee
for
a resident bear hunting license is $13.00. Beginning in 1999,
the
fee for a resident bear hunting license is $14.00. Beginning in
2001,
the fee for a resident bear hunting license is $15.00. The
Except as otherwise provided in subsection (4), the fee for a
nonresident bear hunting license is $150.00.
(2) The department may issue a tag with, or as a part of, a
bear hunting license. Section 43526(2) applies with respect to a
bear hunting license.
(3) In addition to the license fees in subsection (1), the
department shall charge a nonrefundable application fee not to
exceed $4.00 for each person who applies for a bear hunting
license.
(4) The department may annually auction to the highest bidders
up to 5 bear hunting licenses. Each bear hunting license shall
authorize the taking of 1 bear during the bear hunting season. Any
individual may bid on a bear hunting license under this subsection.
(5) Money received from the department's auction under
subsection (4) shall be deposited with the state treasurer to the
credit of the game and fish protection account.
(6) The department or commission, as appropriate, shall issue
any orders necessary to implement this section pursuant to section
40107 or 40113a.
Sec.
43529. (1) A resident person shall not hunt elk during
the
elk season without an elk hunting license. The Except as
provided in subsection (3), an elk hunting license shall not be
issued to a nonresident. Except as provided in subsection (3), the
fee for an elk hunting license is $100.00. The department may
establish a nonrefundable application fee not to exceed $4.00 for
each person who applies for an elk hunting license.
(2) The department may issue a kill tag with, or as a part of,
an
elk hunting license. Section 43526(2) applies with respect to an
elk hunting license.
(3) The department may annually auction to the highest bidders
up to 5 elk hunting licenses. Each elk hunting license shall
authorize the taking of 1 elk during the elk hunting season. Any
individual may bid on an elk hunting license under this subsection.
(4) Money received from the department's auction under
subsection (3) shall be deposited with the state treasurer to the
