     A bill to amend 1976 PA 451, entitled

 

"The revised school code,"

 

by amending section 1502 (MCL 380.1502), as amended by 1993 PA 335.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 1502. (1) Health and physical education for pupils of

 

both sexes shall be established and provided in all public schools

 

of this state. Subject to subsection (2) (4), each pupil attending

 

public school in this state who is physically fit and capable of

 

doing so shall take the course in physical education.

 

     (2) The board of a school district or board of directors of a

 

public school academy shall develop and adopt a local policy for

 

physical education that ensures that physical education is provided

 

for all pupils. The board or board of directors shall submit this

 

local policy to the department not later than December 31, 2008.

 


     (3) Not later than September 1, 2008, the department, in

 

consultation with the governor's council on physical fitness,

 

health, and sports, shall develop and make available to school

 

districts and public school academies a model physical education

 

policy that may be adopted for the purposes of this section.

 

     (4) (2) A If provided in the school district's or public

 

school academy's local policy adopted under this section, a school

 

district or public school academy may credit a pupil's

 

participation in extracurricular athletics or other extracurricular

 

activities involving physical activity as meeting the physical

 

education requirement for the pupil under subsection (1) the

 

policy.
