HOUSE BILL No. 6116

     A bill to amend 1994 PA 451, entitled

 

"Natural resources and environmental protection act,"

 

(MCL 324.101 to 324.90106) by adding section 8512d.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 8512d. Beginning January 1, 2010, a person shall not

 

display for sale a lawn fertilizer or lawn and garden fertilizer

 

containing more than 0.5% of the plant nutrient available phosphate

 

(P2O5). A person that sells lawn fertilizer or lawn and garden

 

fertilizer containing more than 0.5% of available phosphate shall

 

post a sign advising customers in easily legible type of the

 

requirements of section 8512b(1) to (3). The sign may also advise

 

customers, in the same size or smaller type, that lawn fertilizer

 

or lawn and garden fertilizer containing more than 0.5% of

 

available phosphate is available upon request for uses permitted

 


under section 8512b(1) to (3). The sign shall be posted in a

 

conspicuous location. If other fertilizer is displayed, the sign

 

shall be in the area where the other fertilizer is displayed.

 

     Enacting section 1. This amendatory act does not take effect

 

unless Senate Bill No.____ or House Bill No. 6115(request no.

 

05181'07 *) of the 94th Legislature is enacted into law.
