A bill to amend 1978 PA 368, entitled
"Public health code,"
(MCL 333.1101 to 333.25211) by adding section 21742.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 21742. (1) At any time after a proposed change in
ownership or control of a nursing home is reported to the
department under section 20142 and before a license is issued to
the new persons with an ownership or control interest in the
nursing home, the department may or, upon the request of any
person, shall hold a public hearing to provide an opportunity for
all persons interested in the change in ownership or control to be
heard. The department shall consider all information received
during the public hearing and any written communication it receives
with regard to the change in ownership or control when making its
decision whether to issue a license to the new persons with an
ownership or control interest.
(2) In addition to rules required in sections 20171 and 21741,
the department shall promulgate rules to establish the procedures
under which a public hearing is requested and held under this
section.
