A bill to amend 1994 PA 451, entitled
"Natural resources and environmental protection act,"
(MCL 324.101 to 324.90106) by adding section 11514a.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 11514a. (1) The owner or operator of a landfill or
municipal solid waste incinerator shall inspect each day at least 1
load of the solid waste delivered to the disposal area that day and
shall inspect each year at least 1% of the loads of solid waste
delivered to the disposal area that year.
(2) If a load of solid waste is rejected by the owner or
operator of a landfill or municipal solid waste incinerator because
it contains materials whose disposal at the disposal area is
prohibited under this act or rules promulgated under this act, a
solid waste hauler shall not subsequently deliver the load to a
landfill or municipal solid waste incinerator in this state for
disposal unless the solid waste is first processed by a material
recovery facility, a transfer station, or other facility that has
documented that it has removed from the solid waste those materials
that are prohibited from disposal in a landfill or municipal solid
waste incinerator under this act or rules promulgated under this
act.
(3) The owner or operator of a landfill or municipal solid
waste incinerator shall promptly report to the department the
owner's or operator's rejection of a load of solid waste containing
materials whose disposal at that disposal area is prohibited under
this act or rules promulgated under this act.
