SENATE BILL No. 647

     A bill to require a local unit of government to post notice on

 

every highway or street leading into the local unit of government

 

if the local unit of government charges a fee to nonresidents of

 

the local unit of government for providing emergency response

 

services at motor vehicle accidents; and to provide for penalties.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 1. This act shall be known and may be cited as the

 

"emergency response services fee notice act".

 

     Sec. 3. As used in this act:

 

     (a) "Emergency response services" means police department

 

services, fire department services, or emergency medical services.

 

     (b) "Fee" means the cost charged by a local unit of government

 

for providing emergency response services at a motor vehicle

 


accident.

 

     (c) "Highway or street" means that term as defined in section

 

20 of the Michigan vehicle code, 1949 PA 300, MCL 257.20.

 

     (d) "Local unit of government" means a county, city, village,

 

township, or charter township.

 

     Sec. 5. If a local unit of government charges a fee to

 

nonresidents of the local unit of government for providing

 

emergency response services at a motor vehicle accident, the local

 

unit of government shall post at least 1 sign on every highway or

 

street leading into the local unit of government that indicates the

 

local unit of government charges a fee to nonresidents of the local

 

unit of government for providing emergency response services at a

 

motor vehicle accident.

 

     Sec. 7. A local unit of government that does not comply with

 

the requirements of section 5 is subject to a reduction in revenue

 

sharing as provided in section 17c of the Glenn Steil state revenue

 

sharing act of 1971, 1971 PA 140, MCL 141.901 to 141.921.

 

     Enacting section 1. This act does not take effect unless

of the 94th Legislature is enacted into law.
