A bill to amend 1976 PA 69, entitled
"An act to permit the department of history, arts, and libraries to
acquire and operate state historic sites; to accept gifts for that
purpose; and to permit investment in certain funds to carry out the
purposes of this act,"
by amending sections 1, 2, and 3 (MCL 399.111, 399.112, and
399.113), as amended by 2001 PA 73.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec.
1. The department of history, arts, and libraries state
may acquire and maintain historic sites for use by the public. The
department
of history, arts, and libraries state may
receive lands
or rights to lands in the name of the state and for the benefit of
the
public by either purchase or gift. The department of history,
arts,
and libraries state may
enter into contracts for the purchase
of historic sites listed on the state register of historic sites,
and on fulfillment of the terms and conditions in a contract may
accept a deed or deeds.
Sec.
2. The department of history, arts, and libraries state
may receive and hold in trust for the state a grant or devise of
land or rights in land and a gift or bequest of money or other
nonhistoric personal property made for the purposes of this act. If
money or other personal property is received, the property shall be
appraised at current market value and be turned over to the state
treasurer who shall preserve and invest all money and property
received as provided by law. The invested funds shall be known as
the state historic site fund and the proceeds shall be used and
expended
under the direction of the department of history, arts,
and
libraries state to carry out the purposes of this act.
Sec. 3. Any municipality may transfer the care and control of
a historic site or property suitable as a historic site to the
department
of history, arts, and libraries state. The transfer
shall be upon terms and for a period of time as may be mutually
agreed upon.
Enacting section 1. This amendatory act does not take effect
unless Senate Bill No. 503
of the 95th Legislature is enacted into law.
