     A bill to amend 1949 PA 300, entitled

 

"Michigan vehicle code,"

 

(MCL 257.1 to 257.923) by adding section 328a.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 328a. (1) An individual shall report to the secretary of

 

state in person if any of the following occur while he or she is

 

operating a motor vehicle in this state:

 

     (a) He or she is involved in a crash resulting in property

 

damage of $1,000.00 or more.

 

     (b) He or she is involved in a crash resulting in personal

 

injury to any individual.

 

     (c) He or she is stopped by a peace officer for a violation of


 

this act.

 

     (2) An individual shall report as required under subsection

 

(1) within 7 days after the crash or stop. The individual shall

 

present proof to the secretary of state in the manner required by

 

the secretary of state that the vehicle was insured as required

 

under chapter 31 of the insurance code of 1956, 1956 PA 218, MCL

 

500.3101 to 500.3179, at the time he or she was operating the motor

 

vehicle. The secretary of state shall verify the insurance coverage

 

for the vehicle with the stated insurer. If the secretary of state

 

determines that the individual did not have the insurance in force

 

at the time of the crash or stop, the secretary of state shall

 

report the violation to the police department or sheriff department

 

that responded to the crash or made the stop. If no police

 

department or sheriff department responded to the crash, the

 

secretary of state shall report the violation to a police

 

department or the sheriff department having jurisdiction of the

 

location in which the crash occurred.

 

     (3) An individual who fails to report to the secretary of

 

state as required under this section is guilty of a misdemeanor

 

punishable by imprisonment for not more than 93 days or a fine of

 

not more than $500.00, or both.

 

     (4) An individual who knowingly provides false or misleading

 

information to the secretary of state in a report required under

 

this section is guilty of a misdemeanor punishable by imprisonment

 

for not more than 93 days or a fine of not more than $500.00, or

 

both.

 

     (5) As used in this section:


 

     (a) "Crash" means a collision with any object including

 

another vehicle.

 

     (b) "Police department" means the police department of a city,

 

village, township, college, or community college or the department

 

of state police.
