A bill to amend 1973 PA 139, entitled
"An act to provide forms of county government; to provide for
county managers and county executives and to prescribe their powers
and duties; to abolish certain departments, boards, commissions,
and authorities; to provide for transfer of certain powers and
functions; to prescribe powers of a board of county commissioners
and elected officials; to provide organization of administrative
functions; to transfer property; to retain ordinances and laws not
inconsistent with this act; to provide methods for abolition of a
unified form of county government; and to prescribe penalties and
provide remedies,"
(MCL 45.551 to 45.573) by adding section 22a.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 22a. A retiree who is receiving a retirement benefit
under this act and who is employed by a county with a population of
greater than 35,000 offering benefits under this act on or after
July 1, 2010 agrees to forfeit his or her right to receive the
retirement benefit during any period of county employment. The
county retirement system shall cease payment of the retirement
benefit to a retiree described in this section and shall reinstate
payment of the retirement benefit without recalculation when the
period of county employment ceases. This section does not apply to
a retiree who is employed by a county on June 30, 2010 as long as
he or she remains in the position held on June 30, 2010. As used in
this section, "employed by a county" means employed directly by the
county, working as an independent contractor for the county, or
employed indirectly by the county through a contractual arrangement
with third parties.
