CONTENT
The bill would amend the Code of Criminal Procedure to establish an affirmative defense to charges of an offense related to prostitution, for a defendant who committed the offense as a result of being or having been a victim of human trafficking under Chapter 67A of the Michigan Penal Code.
(Chapter 67A generally prohibits forced labor or services through threats, physical harm or restraint, abuse of law, blackmail, and other methods, and the use of a minor for sexually abusive activity.)
The affirmative defense would apply to crimes under Chapter 67 of the Michigan Penal Code. (That chapter generally includes the following crimes: prostitution solicitation; receiving a person for the purpose of prostitution; engaging a female nonspouse for prostitution; assisting another person in prostitution; keeping or maintaining a house for prostitution purposes; leasing a house with knowledge that the lessee intends to use it for prostitution; inducing a female to become a prostitute; leaving a female spouse in a house of prostitution; accepting the earnings of a prostitute; keeping a female in a house of prostitution for debt she contracted while living in there; transporting a female for purposes of prostitution; and allowing a person under 16 years old to stay in a house of prostitution.)
