CONTENT
The bill would amend Part 115 of the Natural Resources and Environmental Protection Act to delay the sunset on the Solid Waste Surcharge Fee from September 30, 2013, to September 30, 2015. The fee is currently 12 cents per cubic yard of solid waste.
FISCAL IMPACT
The bill would have a substantial positive fiscal impact on the Department of Environmental Quality (DEQ) and no fiscal impact on local units of government. In fiscal year (FY) 2011-12, the Solid Waste Surcharge Fee generated approximately $5.2 million.
The FY 2013-14 DEQ budget includes approximately $5.4 million from this surcharge fee. The State Budget Office has projected that the fee will carry approximately a $2.9 million balance into FY 2013-14, so failure to delay the fee sunset would create a roughly $2.5 million hole in the DEQ budget as it was passed by the Legislature.
