CONTENT
House Bill 5117 (H-2) would amend Public Act 156 of 1851, which specifies the powers and duties of county boards of commissioners, to extend from January 1, 2015, to January 1, 2018, the deadline by which a county board of commissioners may adopt a resolution transferring the functions of a board of county road commissioners to the county board of commissioners, or submitting the question of a transfer to the voters.
House Bill 5118 (H-2) would amend the county road law to reflect the deadline extension proposed by House Bill 5117 (H-2) on provisions that allow the transfer of powers and duties as provided in Public Act 156 of 1851.
The bills are tie-barred to each other. House Bill 5117 (H-2) is described in further detail below.
Public Act 156 of 1851 authorizes a county board of commissioners, at a lawfully held meeting, to pass, before January 1, 2015, a resolution that transfers to the county board of commissioners the powers, duties, and functions that are otherwise provided by law for the appointed board of county road commissioners of that county. If the board of county road commissioners is elected, the county board of road commissioners may pass, before January 1, 2015, a resolution to submit to the electors of the county at the next general regular election the question of transferring the powers, duties, and functions of the county board of road commissioners to the county board of commissioners. In either case, after a transfer, the county board of commissioners is authorized to receive and spend funds as allowed under Public Act 51 of 1951, the Michigan Transportation Fund law.
The bill would extend the deadline from January 1, 2015, to January 1, 2018.

FISCAL IMPACT
A county that chose to reconfigure the administration of roads under the extended authority proposed by the bills could have reduced administrative costs. The bills would have no fiscal impact on the State.
