A bill to amend 1978 PA 368, entitled
"Public health code,"
(MCL 333.1101 to 333.25211) by adding section 13402.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 13402. (1) A tanning facility shall register with the
department on a form prescribed by the department. Unless renewed
for an additional calendar year, a registration expires on December
31 of the calendar year for which the registration form was
submitted.
(2) A tanning facility shall submit a registration fee with
its initial or any renewal registration form of $75.00.
(3) If it receives a complete initial or renewal registration
under this section, the department shall issue a certificate of
registration to the tanning facility. A certificate of registration
described in this subsection is valid for the calendar year for
which the registration form was submitted. The owner or operator of
the tanning facility shall display the certificate of registration
in the tanning facility at a place visible to the public.
(4) The owner or operator of a tanning facility shall not
allow an individual to use a tanning device in that tanning
facility if the tanning facility does not have a valid certificate
of registration under subsection (3).
(5) After providing notice and an opportunity for a hearing
under the administrative procedures act of 1969, 1969 PA 306, MCL
24.201 to 24.328, the department may deny, suspend, or revoke the
registration of a tanning facility that violates this part.
(6) A person that violates this section is guilty of a
misdemeanor punishable by imprisonment for not more than 93 days or
a fine of not more than $2,000.00, or both, for each violation.
