A bill to amend 1976 PA 388, entitled
"Michigan campaign finance act,"
(MCL 169.201 to 169.282) by adding section 48.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 48. (1) An automated telephonic communication with an
elector that relates to an election, a candidate, or a ballot
question shall clearly state the identity of the person paying for
the communication. A communication described in this subsection
shall clearly state the following disclaimer: "Authorized by (name
of candidate, name of candidate committee, or name of person paying
for the communication)".
(2) A person making a communication that violates this section
is subject to the following:
(a) For a first violation, a civil fine of not more than
$500.00.
(b) For a second violation, a civil fine of not more than
$1,000.00.
(c) For a third or subsequent offense, a civil fine of not
more than $1,500.00.
(3) A person paying for a communication that violates this
section is subject to the following:
(a) For a first violation, a civil fine of not more than
$500.00.
(b) For a second violation, a civil fine of not more than
$1,000.00.
(c) For a third or subsequent offense, a civil fine of not
more than $1,500.00.
