A bill to amend 1968 PA 2, entitled
"Uniform budgeting and accounting act,"
(MCL 141.421 to 141.440a) by adding section 3a.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 3a. (1) Notwithstanding any charter provision to the
contrary, beginning on the effective date of the amendatory act
that added this section, a local unit shall not enter into a
contract for the purchase of apparatus, materials, equipment, or
supplies involving an expenditure of more than $20,000.00 unless
competitive bids are obtained and the contract is awarded to the
lowest responsive and responsible bidder or awarded on the basis of
best value.
(2) Notwithstanding any charter provision to the contrary,
beginning on the effective date of the amendatory act that added
this section, a local unit shall not enter into a contract for
services relating to the installation, maintenance, or repair of
apparatus, materials, equipment, or supplies involving an
expenditure of more than $20,000.00 unless competitive bids are
obtained and the contract is awarded to the lowest responsive and
responsible bidder or awarded on the basis of best value.
(3) As used in this section:
(a) "Best value" means awarding a contract to a responsive and
responsible bidder by optimizing quality, cost, and efficiency as
determined by all of the following criteria:
(i) The bidder's financial resources.
(ii) The bidder's technical capabilities.
(iii) The bidder's professional experience.
(iv) The bidder's past performance.
(v) The bidder's insurance and bonding capacity.
(vi) The bidder's business integrity.
(b) "Responsive and responsible bidder" means a bidder who
complies with all bid specifications and requirements.
