A joint resolution proposing an amendment to the state
constitution of 1963, by adding section 55 to article IV, to
prohibit the legislature from enacting legislation that has a
negative fiscal impact on public education without enacting
accompanying legislation that provides funding to offset the
negative fiscal impact.
Resolved by the Senate and House of Representatives of the
state of Michigan, That the following amendment to the state
constitution of 1963, to prohibit the legislature from enacting
legislation that has a negative fiscal impact on public education
without enacting accompanying legislation that provides funding to
offset the negative fiscal impact, is proposed, agreed to, and
submitted to the people of the state:
ARTICLE IV
Sec. 55. The legislature shall not enact legislation that has
a negative fiscal impact on this state's system of elementary and
secondary public education unless it also enacts accompanying
legislation that provides funding to offset the negative fiscal
impact.
Any legislation enacted in violation of this section is
unenforceable until legislation is enacted to offset the negative
fiscal impact.
As used in this section, "negative fiscal impact" means to
increase the costs imposed upon public education or to reduce
revenue available for the funding of public education.
Resolved further, That the foregoing amendment shall be
submitted to the people of the state at the next general election
in the manner provided by law.
