SUMMARY:
House Bill 5102 would amend Sections 3a and 4 of the Stille-DeRossett-Hale Single State Construction Code Act by changing the composition of membership on the State Construction Code Commission. The bill would take effect 90 days after the date it is enacted.
The commission exists within the Department of Licensing and Regulatory Affairs (LARA), and presently does not include fire service representatives. The bill would add two such representatives so that if the bill were to pass, the membership of the commission would be composed of the following:
o The state fire marshal or an employee of the Bureau of Fire Services designated by the state fire marshal.
o Two fire service representatives with extensive background in fire inspection, plan review, and fire prevention who would be appointed by the governor from candidates recommended by the state fire marshal. The state fire marshal would recommend candidates to the governor from individuals recommended to the state fire marshal by one or more statewide associations of fire chiefs, fire inspectors, or firemen.
o A designee of the chairperson from each of the following: the state plumbing board, the board of mechanical rules, the electrical administrative board, and the barrier free design board.
o Twelve residents of the state to be appointed by the governor with the advice and consent of the State Senate. These appointed members would have to include the following:
§ One individual from each of the fields of industrial management, architecture, professional engineering, building contracting, organized labor, and premanufactured building.
§ Three individuals representing municipal building inspection.
§ Two individuals from the general public.
§ One licensed residential builder.
House Bill 5102 also would add a provision stating that if the director were to appoint an advisory committee to review recommendations of any of the boards, the advisory committee must include three fire service representatives with extensive background in fire inspection, plan review, and fire prevention appointed by the director from candidates recommended by one or more statewide associations of fire chiefs, fire inspectors, or firemen. Lastly, the bill would make other technical amendments that do not substantially impact the present meaning of these sections.
FISCAL IMPACT:
House Bill 5102 would not have a significant fiscal impact on the state or local units of government.
