SENATE BILL No. 669

     A bill to control noise; and to prescribe civil sanctions.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 1. A person shall not make or cause or assist in the

 

making or causing of loud noise that disturbs, injures, or

 

threatens the peace, comfort, health, or safety of an individual.

 

     Sec. 2. A person shall not do any of the following:

 

     (a) Sound any horn or other audible signaling device on any

 

motor vehicle on a public road or street or other public property

 

except as a danger warning; create by means of such a device an

 

unreasonably loud or harsh noise; sound such a device for an

 

unreasonable period of time; or sound such a device because traffic

 

is held up.

 

     (b) Use, play, operate, or authorize to be used, played, or

 

operated a radio receiver, musical instrument, digital or analog

 


audio player, loudspeaker, amplifier, or other device for producing

 

or reproducing sound on private property or in or from a vehicle on

 

a public road or street or other public property at a volume that

 

disturbs the peace or comfort of an individual of reasonable

 

sensitivity who is not on the private property or not in or on the

 

vehicle. The operation of such a device between 12 midnight and 5

 

a.m. at a volume that is plainly audible at a distance of 50 feet

 

from the private property or vehicle where the device is located is

 

prima facie evidence of a violation of this subsection.

 

     (c) Use, operate, or authorize to be used or operated a radio

 

receiver, musical instrument, digital or analog audio player,

 

loudspeaker, amplifier, or other device for producing or

 

reproducing sound for the purpose of commercial advertising at a

 

volume that disturbs the peace or comfort of an individual of

 

reasonable sensitivity on a public road, street, or sidewalk.

 

     (d) Keep an animal or animals that, by causing frequent or

 

long continued noise, disturb the peace or comfort of any

 

individual of reasonable sensitivity who is not on the property

 

where the animal or animals are kept.

 

     (e) Blow a locomotive steam whistle or steam whistle attached

 

to a stationary boiler, except to give notice of the time to begin

 

or stop work, as a warning of fire or other danger, or upon the

 

request of proper government authorities.

 

     (f) Discharge into the open air the exhaust of a steam engine,

 

stationary internal combustion engine, or motor vehicle, except

 

through a muffler or other device that effectively prevents loud or

 

explosive noises.

 


     (g) Use a motor vehicle so out of repair, so loaded, or in

 

such a manner as to create loud and unnecessary grating, grinding,

 

rattling, or other noise.

 

     (h) Screech tires of a motor vehicle intentionally or by

 

immoderate operation.

 

     (i) Create noise on a public road or street adjacent to a

 

school other than a home school, to an institution of higher

 

education, to a church or other house of worship, or to a court

 

while in use, or adjacent to any hospital, that unreasonably

 

interferes with the function of the entity or disturbs staff or

 

patients in the hospital. This subdivision does not apply unless a

 

conspicuous sign visible from the road or street indicates the

 

presence of the institution.

 

     (j) Use a musical instrument or other device to create

 

unreasonably loud noise for the purpose of attracting attention to

 

any commercial performance, commercial show, or sale.

 

     (k) Operate between 12 midnight and 5 a.m. a pile driver,

 

steam shovel, pneumatic hammer, derrick, steam or electric hoist,

 

or other machine, if the operation causes loud or unusual noise.

 

     Sec. 3. A person who violates this act is responsible for a

 

state civil infraction and may be ordered to pay a civil fine of

 

not more than $100.00.

 

     Enacting section 1. This act takes effect 90 days after the

 

date it is enacted into law.
