A bill to amend 1978 PA 368, entitled

"Public health code,"

(MCL 333.1101 to 333.25211) by adding section 20135; and to repeal acts and parts of acts.

the people of the state of michigan enact:

Sec. 20135. (1) Notwithstanding any other provision of this article to the contrary, any employee or volunteer of a health facility or agency may assist with feeding or transporting a patient or resident in accordance with the patient's or resident's plan of care if instructed to do so by a health professional and the employee or volunteer is under the supervision of the health professional.

(2) This section does not apply to an ambulance operation, aircraft transport operation, nontransport prehospital life support operation, or medical first response service.

(3) As used in this section, "health professional" means that term as defined in section 5673.

(4) This section is repealed effective 120 days after the effective date of the amendatory act that added this section.
